Please read these Terms of Service (“Terms”) carefully before using the Link Software platform (the “Service”), operated by Link. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of the Terms, you may not access the Service.


1. Scope of the Service

Link provides a software-as-a-service (SaaS) platform for hospitality businesses. The Service includes an application widget and a dashboard to manage applicants.


2. Subscription and Renewal

The Service is offered as a 12-month subscription starting on the date of the first payment. The first 30 days are a paid trial and may be cancelled in writing at any time during this period. If not cancelled within the first 30 days, the subscription continues for the remainder of the 12-month term and automatically renews unless cancelled in writing at least 30 days before the end of the current term. All subscriptions are subject to these Terms.


3. Payment

All payments are processed securely through Stripe. Subscription fees are billed monthly unless otherwise agreed. Prices are exclusive of VAT unless stated otherwise. Payments are non-refundable unless required by applicable law. Your agreement to these Terms is confirmed by submitting your first payment.


4. Customer Responsibilities

You are responsible for using the Service in compliance with all applicable laws and regulations. You must ensure that only authorized personnel have access to the dashboard and that login credentials are kept secure. Misuse of the Service, including unauthorized access or data handling, may result in termination.


5. Acceptable Use

You agree not to:

  • Use the Service in any unlawful, fraudulent, or harmful way

  • Attempt to disrupt or compromise the integrity of the platform

  • Circumvent access controls or use scraping tools

  • Introduce malware or other malicious technologies


Link reserves the right to suspend or terminate access immediately in case of a breach of this policy.


6. Data and Privacy

When applicants submit information through your widget, Link stores that data on your behalf to support your recruitment process. Link is the data controller for the information collected through the widget and is responsible for ensuring that data is processed in accordance with applicable privacy laws, including the GDPR.

Applicant data is processed solely for the purpose of providing the Service. A Data Processing Agreement (DPA) is available upon request.

Unless the applicant requests earlier deletion, data is retained for up to 36 months by default. After contract termination, you will have 30 days to export your data before it is permanently deleted or anonymized.

You may not use the Service to collect or process sensitive personal data unless you have obtained proper consent and ensured compliance with applicable privacy laws.


7. Security

Link applies industry-standard security protocols including encrypted transmission, access control, and regular system monitoring. However, no platform can be guaranteed entirely secure. Customers are expected to take reasonable precautions to safeguard their login credentials and usage environment.


8. Availability and Modifications

Link aims for high availability of the Service but does not guarantee uninterrupted access. Maintenance, updates, or technical issues may occasionally affect uptime. Link may change or improve features without prior notice. Material changes will be communicated at least 30 days in advance.


9. Termination

You may cancel your subscription at the end of any 6-month term with 30 days’ written notice. Link may terminate or suspend access to the Service immediately if there is a material breach, non-payment, or misuse. No refunds are provided for early termination.


10. Intellectual Property

All software, branding, and materials provided as part of the Service are the intellectual property of Link or its licensors. You are granted a limited, non-transferable license to use the Service during your subscription. You may not reverse-engineer, copy, or resell any part of the platform.


11. Disclaimer

The Service is provided “as is” and “as available” without warranties of any kind. Link does not guarantee that the Service will be error-free, timely, secure, or uninterrupted. You use the Service at your own risk.


12. Limitation of Liability

To the maximum extent permitted by law, Link is not liable for indirect, incidental, or consequential damages. Link’s total liability for any claim related to the Service will not exceed 15% of the total amount paid by you in the preceding 12 months.


13. External Links

The dashboard or website may contain links to third-party websites. Link is not responsible for the content or availability of these sites and does not endorse them.


14. Changes to These Terms

We may update these Terms to reflect changes in the law or our Service. Any material updates will be communicated via email or in-app notification at least 30 days in advance. Continued use of the Service after that date indicates your acceptance of the new Terms.


15. Governing Law and Jurisdiction

These Terms are governed by Dutch law. Any disputes will be submitted to the competent court in Amsterdam, unless otherwise required by applicable consumer protection laws.
